Decisions by the Secretary pursuant to the authority of this Act are non-reviewable and committed to agency discretion, and may not be reviewed by any court of law or any administrative agency.

One of the bloggers for Foreign Policy has floated the idea that the Executive branch's bailout plan is deliberately unpalatable: the idea is that the Democrats will be forced to come up with an alternate plan -- and then they will share in the blame if things don't work out.

This seems totally plausible to me, and appealing, too. Appealing because it means that the Bush administration is merely cynical rather than outright diabolical. The former view is, of course, ahistorical.
